1.1. These terms and conditions are for the Badstroke Guitars online store at www.badstrokeguitars.com run by Ondřej Bubík registered office Radlicka 571/70, Praha 5, 15000, Czech Republic for the sale of offered products or custom-made products. Products on the site are sold new unless otherwise stated.
1.2. The wording of the terms and conditions may be changed or supplemented by the seller. This provision does not affect the rights and obligations arising during the effective period of the previous version of the terms and conditions.
1.3. By sending an order request for any product from Badstroke Guitars you declare that you are familiar with and agree to the terms and conditions. The data recorded by Badstroke Guitars constitutes proof of all transactions made by its customers.
1.4. All Badstroke Guitars designs are the sole property of Ondřej Bubík and may not be used or taken by anyone else.
2.1. To order Custom build, the buyer fills out the order form in the web interface of the store. The order form is not binding.
To buy Fiend Series, the buyer fills out the order form in the web interface and pay directly on the website after submitting an order.
To buy Stock item, the buyer choose the product and fills the item specifications and pay directly on the website after submitting an order.
2.2. For Full Custom: The order becomes binding only when both parties agree in writing via e-mail on the final product and the price in the order form, and customers will be sent either a deposit of 50% of the total price of the ordered product or 100% with 5 % discount which will arrive at the Badstroke Guitars account. The buyer will receive first, “pro-forma invoice” after both parties agree in writing. This Pro-forma invoice must be paid within 14 days, otherwise the order will be not submitted. Shipping, final cost and possible surcharges will be taken into account in the final invoice, sent when the build is finished. Final invoice has to be paid before sending the finished build.
For Fiend Series: The order becomes binding after submitting and paying order via website www.badstroke.com. The final invoice will be sent to the email of the buyer, provided by him on the website.
For Stock items: The order becomes binding when the order is finished and paid via website www.badstroke.com. The final invoice will be sent to the email of the buyer, provided by him on the website.
2.3. Sending the deposit constitutes an agreement to these terms and conditions and to the specifications finalized up to the date of the transfer.
The seller is always entitled, depending on the nature of the order (quantity of goods, purchase price, estimated shipping costs), to ask the buyer for additional confirmation of the order (for example, in writing or by phone).
2.4. Badstroke Guitars reserves the right to cancel an order at any stage prior to beginning construction of the project if the luthier believes that the project has developed into something he is not able or willing to build. If we cancel a build then the deposit will be refunded to the client.
2.5. After confirming the order on the order form, it is not possible to change the order during the order processing.
2.6. Any change to the order form must first be confirmed by Badstroke Guitars and may result in a price change. Any change will be reflected in the final invoice. Once the specifications of a custom build have been finalized and work on the actual instrument has commenced there will be a 10% surcharge from total price plus material and time costs on any substantial changes to those specifications, ie any changes which mean a change in the machining required, woodwork or changes to hardware or pickups. If the change request comes at a time when the given part of the guitar has not yet been worked on, it is possible to make the change without fees, the buyer will pay only for additional costs of substantial changes. Any changes to the building process must be confirmed in writing.
3.1. Prices are determined by Badstroke Guitars and are subject to change at any time. The customer undertakes to pay the sales price valid at the time of placing the order.
3.2. The prices of our products are listed in euros excl. VAT and shipping.
3.3. Third country customers must pay customs and other necessary charges according to the rules of their specific country and are not covered by Badstroke Guitars.
3.4. Reservation of title clause. Products remain the property of Badstroke Guitars until paid in full to Badstroke Guitars.
4.1. Payment is made either in cash or by transfer via Wise, bank transfer or by card payment. Payment terms for the order may be agreed on a case-by-case basis.
4.2. Payment instructions will be received by the customer at the last step of the purchase (applies to Fiend Series and Stock), or through data provided directly by Badstroke Guitars (applies to Full Custom). The relevant invoice number must be attached to the transfer.
4.3. Badstroke Guitars also reserves the right to refuse delivery or to fulfill an order from a customer who has not paid in whole or in part for a previous order or with whom a payment dispute is pending.
5.1. Badstroke Guitars undertakes to provide all means at its disposal to deliver the order in the most reasonable time possible, after receipt of order confirmation and deposit.
5.2. The delivery times announced by the customer are given for information only and any delay does not entitle the buyer to cancel the order, reject the goods, ask for refund or claim damages.
5.3. The customer has the right to receive information about the production process. Customers who ordered a Full Custom instrument have the opportunity to receive photos and consultations with luthier during the entire process. Customers who ordered Fiend Series will receive several common updates for the entire batch during the process via email or other preferred way.
5.4. The full custom customer has the right to choose a piece of wood for the top and fingerboard.
Fiend Series customers do not have the option of choosing an exact piece of wood and note that (1) wood has different textures, holes and inaccuracies, (2) color behaves differently on each piece of wood and may differ slightly from the original image.
5.5. Fiend Series Signature and Fiend Series Pro cannot be changed, outside of the possibilities that we offer in the given category.
5.6. The customer has the right to refuse to share his ordered product on Badstroke guitars social networks.
5.7. Production time depends on the build. Production time may vary depending on the complexity and availability of materials.
Approximate production time of Fiend Series: 6 months.
Approximate production time Full Custom: 12 months.
Approximate production time for stock guitar pickups: 1 month.
5.8. Finished builds: For Full Customs, when the final order is ready, the customer will receive photos of the final product and an estimate of the amount that needs to be paid for the product and shipping (Final invoice). Sending the balance plus shipping means you have seen photos of your guitar and agree that there are no cosmetic issues with the assembly and that it was made to your specifications.
5.9. For Fiend Series the customer will receive photos of the final product and confirm in writing that there are no cosmetic issues with the build and that it was made to your specifications.
5.10. Customers who ordered an In stock instrument will receive a final photo of the instrument with pickups of their choice. After they approve in writing that everything is okay, their instrument will be shipped.
5.11. For Full Custom: After receiving the second part of the payment, we will send the product to the customer by the service chosen by the sender. If the second part of the payment (Final invoice) is not paid within 1 month of the termination notification, the client loses all rights to the product and the product will be sold to cover costs.
5.12. All packages shipped by Badstroke Guitars are insured.
6.1. Our Custom, Fiend series and In Stock products and instruments are non-returnable and non-refundable as they are made specifically for them. A refund is not possible even in case of an extension of the delivery period.
6.2. Custom builds, Fiend Series and In Stock instruments can only be repaired in terms of a defect. If the problems persist even after the defect has been repaired, we will deal with the refund on a case-by-case basis.
6.3. If the product needs to be sent back to Badstroke guitars for return or repair, shipping will be paid by Badstroke Guitars.
6.4. In case of damage to the product during shipping, we will take care of the repair and compensation. In case of repetitive damage, we will assess the cases individually according to the agreement between Badstroke Guitars and a customer.
7.1. The warranty is limited to one year from the delivery of the product, unless otherwise stated.
7.2. Badstroke guitars warrants solely to the original purchaser of this Badstroke Guitars musical instrument that the instrument purchased shall be free from defects in materials and workmanship under normal use for as long as the instrument is owned by the original purchaser, and until the ownership of the instrument is transferred to another (unless otherwise noted by Badstroke Guitars).
7.3. This Limited Warranty does not apply: (a) to wear or breakage of frets or strings, or other normal wear and tear of the instrument or its parts; (b) to asserted defects caused by modification, misuse or abuse or improper maintenance of the instrument; (c) to asserted defects involving subjective personal likes or judgements; (d) to asserted defects caused by accident or exposure to extremes of temperature or humidity which cause harm to the instrument; (e) to defects asserted by any purchaser who did not purchase the instrument directly from Badstroke Guitars and where serial number is not available. (f) to Instruments that have been serviced by unauthorized persons (any person other than Badstroke Guitars or a Badstroke Guitars-authorized guitar repairman/technician/luthier).
7.4. Limitation on Obligations. The obligations of Badstroke Guitars here under are limited to repair or replacement of parts of the instrument found to be defective under this Limited Warranty. In no event shall Badstroke Guitars be liable for any indirect, incidental or consequential damages, including but not limited to time, wages or lost profits, of any nature or kind or for damages to or loss of property.
7.5. In specific cases, Badstroke guitars within minor adjustments is willing to pay for the repair in the customer’s country, as long as Badstroke Guitars assesses that the quality and price of the third party repairing the product is appropriate. If this option is used, the warranty for the product stays, but not for the part which was repaired by third party. Badstroke guitars do not take responsibility for the quality of the repair by the third party.
